Participation in the Game, Prize Award and Date of the Prize: |
Only natural persons aged 18 or older, residing or having a place of stay in one of the following European Union countries, holding a valid ID issued by the competent authority of said country, and having a personal Mobilredfox webshop profile, may participate in the Game throughout its entire duration, provided they are legally competent and not part of the excluded persons (“Player”). Participating countries: Hungary, Czech Republic, Poland, Romania, Bulgaria, Greece, Slovenia, Slovakia, the Netherlands, Croatia, Italy. Persons under 18 years of age may only participate and claim the prize with the consent of their legal representative. This consent must be presented upon request to Mobilredfox Customer Service by any Player or Winner. Participation in the Game is possible by creating a personal profile on the Mobilredfox website and purchasing a Product. The prize consists of 9 (nine) cash prizes worth €990 each, 9 (nine) Apple iPhone 16 Pro devices, and 9 (nine) Apple AirPods Pro (the “Prize”). One purchase counts as one chance; the number of phone cases purchased does not increase the chances of winning. Extra chances can be obtained by purchasing Mystery Pack1 or Mystery Pack2 in addition to the base order. The Organizer reserves the right to change the Prize and replace it with another item of the same or higher value. All Players who make a purchase during the promotion period and buy at least one Full-Shock or Pro-Shock case via the Organizer's website are deemed registered and accept the terms outlined in this Game Rules document. This Game does not qualify as gambling under Act XXXIV of 1991 on the Organization of Gambling. MOBILREDFOX creates a closed database of the Players participating in the Game. From this database, MOBILREDFOX randomly selects the Winners using a computer without any human intervention. The draw will take place on the date specified above. The draw is not public. No substitute winner will be drawn. The Organizer will draw a total of 27 (twenty-seven) Winners. If the Winner does not respond within 72 hours, or if their participation is invalid for any reason, or they are excluded for any other reason outlined in these Game Rules, or if they do not claim the Prize at the agreed time and location, the Prize will not be redrawn. This Game is not sponsored, endorsed, organized, or associated with Apple Inc. The data provided during the purchase will not be shared with Apple, but stored in MOBILREDFOX’s database and used in accordance with these Game Rules. Apple neither supports nor participates in the Game in any way. Apple does not administer or monitor the participants of the Game. |

The prize consists of 9 (nine) cash prizes of €990 (nine hundred and ninety euros), 9 (nine) Apple iPhone 16 Pro devices, and 9 (nine) Apple AirPods Pro (the “Prize”). The Prize is non-transferable and may only be awarded to the Winner. The Prize cannot be exchanged for cash or refunded. The Prize cannot be sold commercially. MOBILREDFOX will notify the Winner within 72 hours of the draw (“Notification”):
The Winner is obliged to confirm the Notification and contact MOBILREDFOX Customer Service within the given timeframe. If the Winner does not confirm the Notification or fails to provide the required data for delivery, they will be disqualified and will forfeit the Prize. If the Winner provides false, incomplete, or incorrect personal information, or otherwise fails to meet the conditions of these Game Rules, the Organizer disclaims all responsibility, and the Winner will be excluded from the Game. The Organizer’s responsibility is limited solely to the provision of the Prize. It is not responsible for any additional conditions related to the use or acceptance of the Prize. MOBILREDFOX excludes all liability for any issues that arise during or after the use of the Prize by the Winner or any third party. |

The following individuals may not participate in the Game:
Participation in the Game is entirely voluntary. If the Winner cannot be contacted (e.g. due to email filtering, social media settings, etc.), and therefore loses their entitlement to the Prize, no further claims can be made against MOBILREDFOX. If the Winner provides false or incomplete information, or becomes ineligible for any reason, MOBILREDFOX is not obliged to draw a replacement Winner or to re-deliver the Prize. To receive the Prize, the Winner must prove their identity. The Winner is responsible for all other costs related to the Prize delivery (e.g. travel, accommodation). By participating, the Player acknowledges that MOBILREDFOX may deliver the Prize at a public event and may publish the Winner’s photo and media interview in relation to the Prize.
MOBILREDFOX shall not be held liable for any website malfunctions beyond its control. MOBILREDFOX is not responsible for any external cyberattacks affecting the website or its servers. The Organizer assumes no responsibility for:

Participation using a customer profile not registered by the Player personally will result in automatic disqualification. Players must engage in impartial and respectful communication. All data submitted during the Game will be stored in MOBILREDFOX’s database and used only as specified in these Game Rules.
MOBILREDFOX reserves the right to modify these Game Rules at any time. It may exclude any Player in the event of fraud, violation of the rules, or manipulation of the Game process. Anyone acting in bad faith may be removed from the Game. The Game may be suspended or terminated early in the event of force majeure (e.g. war, earthquake, disaster, pandemic, strike, or other unforeseen events). MOBILREDFOX assumes no liability for damages or costs resulting from the Game being modified, suspended, or terminated. If a technical or security issue prevents the lawful execution of the Game, MOBILREDFOX reserves the right to pause or terminate it. Any notifications about modifications, suspension, or termination will be published at: https://mobilfox.com/pages/mobilredfox-9th-birthday-game-rules Players providing false data will be automatically excluded. Participants who act dishonestly or unfairly are liable to reimburse any damages caused to the Organizer. If MOBILREDFOX detects or reasonably suspects any computer manipulation, mass profile creation, or other behavior violating the spirit of the Game, it will immediately exclude the Player. The Organizer is not liable for any delay or failure to deliver the Prize due to reasons beyond its control. If the Winner does not collect the Prize at the agreed time, they may no longer claim it later. The Game and these Game Rules are governed by Hungarian law. Taxation Cash Prizes:

PRIVACY POLICY AND DATA PROTECTION NOTICE
By accepting the Terms, you explicitly consent—based on appropriate information—that your personal data may be processed and stored by MOBILREDFOX, as the data controller, in accordance with Article 6(1)(a) of Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR), and in line with all applicable legal regulations, for the purpose of participating in the Prize Draw and maintaining contact, for the duration necessary to achieve the stated purpose or until you withdraw your consent, as specified in the privacy policy.

MOBILREDFOX processes the data of Players based on their consent, in line with Article 6(1)(a) of the GDPR. In the case of selected winners, data is processed on a contractual basis, in accordance with Article 6(1)(b) of the GDPR, in order to fulfill the prize delivery and the associated gift agreement.
During the organization of the Prize Draw and the delivery of the prizes, MOBILREDFOX processes the following personal data: in the case of all Players – name, email address, and phone number; and in the case of Winners – name, email address, phone number, and additional information as required by accommodation or travel providers. The data is processed for five years following the closure of the Game, in line with general limitation rules under Hungarian civil law. Any financial data generated in connection with the prize, qualifying as accounting documents, will be processed for a minimum of eight years, in accordance with Section 169(2) of Act C of 2000 on Accounting.
If data is processed based on your consent, you may withdraw that consent at any time, without restriction, conditions, or justification, by sending an email to info@mobilfox.com. Upon withdrawal, MOBILREDFOX will promptly delete your data.
No automated decision-making or profiling is carried out during data processing. There is no targeted data transfer directly related to the Game; however, for registered accounts, the Data Controller may transmit personal data to its data processors (particularly Shopify and Infobip), which could result in the transfer of data to third countries (especially the United States). Details on such processors, the categories of data transmitted, and the legal bases for such transfers under Chapter V of the GDPR can be found in Annex 3 of the Privacy Policy.
The Data Controller takes all reasonable technical and organizational measures to ensure that personal data is not accidentally damaged or destroyed. These specific measures are described in detail in the Privacy Policy.
According to the GDPR, you have the right to be informed about how your data is handled, to access your personal data, to request its rectification or erasure, to restrict its processing, to object to its processing, and to exercise your right to data portability. You are entitled to information on the purpose, legal basis, and duration of the processing, as well as the identity and contact details of the Data Controller and its representatives, the recipients of your personal data, and your rights and available remedies (including the right to lodge a complaint with the supervisory authority). This information is provided through this Privacy Notice.
You have the right to request confirmation about whether your personal data is being processed and to receive access to the data and related information. You are entitled to one free copy of your data; additional copies may incur a reasonable administrative fee. You may also request the correction of inaccurate data and the completion of incomplete data.
You may request the erasure of your personal data if it is no longer necessary for the purpose for which it was collected, if you withdraw your consent and there is no other legal basis for the processing, if the data has been unlawfully processed, or if it must be deleted to comply with a legal obligation. If the processing is based on your consent, withdrawing it will mean you will no longer be able to use features dependent on that consent. Withdrawal does not affect the legality of data processing carried out prior to it.
You may request a restriction on the processing of your data in specific cases, such as when the accuracy of the data is contested, or if the data is no longer needed for processing but is required for legal claims.
You also have the right to receive the data you have provided in a structured, commonly used, machine-readable format and to transmit that data to another data controller, where technically feasible. You may also request that your data be directly transferred between controllers.
If you feel your rights have been violated, you may submit a complaint to the Hungarian National Authority for Data Protection and Freedom of Information (1055 Budapest, Falk Miksa utca 9–11.), or initiate legal proceedings. The burden of proving compliance with data protection laws lies with the Data Controller. If damage is caused due to unlawful processing or data security failures, you may be entitled to compensation or moral damages. The Data Controller is not liable for damages if it proves that the harm was caused by an unavoidable external event beyond its control.
